Terms of Service

These Terms of Service ("Terms") govern your use of the "Send Files" service, which is a service provided by Publishd Pty Ltd. By accessing or using the Service, you agree to be bound by these Terms.

1. User Content and License

You retain all ownership rights to the data, information, and files ("User Content") that you upload, store, or share on the Service. However, to enable the Service, you grant Publishd Pty Ltd a non-exclusive, royalty-free, worldwide, transferable license to access, use, host, move, transmit, display, and share your User Content as directed by you. This license is granted solely for the purpose of operating, improving, and providing the Service to you and is strictly limited to the functions required to host and share your data as initiated by you.

2. Disclaimer of Warranties

The Service is currently in a testing phase. While we make every effort to maintain and run a fast and secure service, we do not guarantee the safe storage or reliability of the Service. The Service is provided "as is," without any warranties of any kind, whether express or implied. You acknowledge and agree that your use of the Service is at your own risk.

3. Limitation of Liability and Indemnification

In no event shall Publishd Pty Ltd, its directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of data, loss of profits, or service interruption, arising out of your use or inability to use the Service. You agree that you cannot hold us accountable for any failures of the Service. It is your sole responsibility to take the necessary steps to ensure that any data you transmit to the Service is securely backed up elsewhere.

You agree to indemnify and hold harmless Publishd Pty Ltd and its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

4. Termination

This agreement between us ends upon the termination of a paid or free plan, or the cancellation of your account. Your data will be permanently deleted and erased from our servers immediately after the termination of a paid plan unless a new paid plan is initiated.

For users without a paid plan, this agreement will be terminated after 180 days of inactivity. Upon termination for inactivity, any stored data will be permanently deleted and erased from our servers.

5. Governing Law

This agreement is governed by the laws of Sydney, New South Wales, Australia. Any disputes arising from these Terms will be resolved in the courts of New South Wales, Australia.
